BaxEnergy Italia s.r.l. a Yokogawa Company, in line with the provisions of Legislative Decree 24/2023, has activated an internal system for reporting acts or facts that may constitute violations of regulations governing the Company’s activities or other unlawful conduct in accordance with the so-called Whistleblowing legislation.
The following can make a whistleblowing report
- employees and assimilated workers, self-employed workers, consultants who work or have worked for BaxEnergy Italia s.r.l;
- persons with functions of administration, control, supervision or representation.
In accordance with Legislative Decree 24/2023, which transposes in Italy the Directive (EU) 2019/1937 concerning the “protection of persons who report breaches of Union law and laying down provisions regarding the protection of persons who report breaches of national laws” (so-called whistleblowing), the company BaxEnergy Italia s.r.l. makes use of the Whistleblower Software by Formalize Platform.

Within the platform, you will find all indications on how to report – confidentially and without fear of retaliation – cases of (alleged) unlawful conduct and/or violations of company policies, which you have become aware of in the context of your work within the company or in relation to the company.
It should be noted that the Whistleblowing channel is not intended for receiving complaints forwarded by customers or requests of an operational/commercial nature, as well as disputes, claims or requests linked to a personal interest or concerning interpersonal issues.
Data management and security will be handled and guaranteed with the utmost care, in accordance with the requirements of current and future privacy legislation (Legislative Decree 196/2003 and EU Regulation 679/2016).
The personal data and information acquired by the Company will be processed by the same in its capacity as Data Controller for the relevant management and will be kept no longer than 5 years from the final outcome of the procedure and has as its legal basis the fulfilment of a legal obligation. The data controller is Dr. Roberto Tundo.
Privacy Policy pursuant to GDPR (General Data Protection Regulation – EU Regulation 2016/679).
The warning may be made by revealing one’s identity or by remaining anonymous. In the event that you choose not to remain anonymous, BaxEnergy Italia s.r.l. will process the personal data guaranteeing the confidentiality of the identity of the reporter and other persons involved in the report, as well as the content of the report and related documentation.
BaxEnergy Italia s.r.l. also guarantees the absence of retaliation against those who report in good faith.

BaxEnergy Italia s.r.l. a Yokogawa Company, in linea con le disposizioni previste dal D.Lgs. 24/2023, ha attivato un sistema interno di segnalazione di atti o fatti che possano costituire violazioni di norme disciplinanti l’attività della Società o altre condotte illecite secondo la normativa cd. Whistleblowing.
Possono effettuare una segnalazione whistleblowing:
- i lavoratori dipendenti e assimilati, i lavoratori autonomi, i consulenti che svolgono o hanno svolto la propria attività lavorativa presso BaxEnergy Italia s.r.l.;
- le persone con funzione di amministrazione, controllo, vigilanza o rappresentanza.
In conformità al D.Lgs. 24/2023, che recepisce in Italia la Direttiva (UE) 2019/1937 riguardante la “protezione delle persone che segnalano violazioni del diritto dell’Unione e recante disposizioni riguardanti la protezione delle persone che segnalano violazioni delle disposizioni normative nazionali” (cd. whistleblowing), la società BaxEnergy Italia s.r.l. si avvale della Piattaforma Whistleblower Software by Formalize.

All’interno della piattaforma si troveranno tutte le indicazioni relative alle modalità di segnalazione – in modo riservato e senza il timore di ritorsioni – di casi di (presunti) comportamenti illeciti e/o di violazioni delle policy aziendali, di cui si sia venuti a conoscenza nell’ambito del proprio contesto lavorativo all’interno della società o in relazione a quest’ultima.
Si precisa che il canale Whistleblowing non è destinato alla ricezione di reclami inoltrati da clienti o richieste di natura operativa/commerciale, nonché contestazioni, rivendicazioni o istanze legate ad un interesse di carattere personale ovvero aventi ad oggetto questioni interpersonali.
La gestione e la sicurezza dei dati verranno gestite e garantite con la massima attenzione, conformemente a quanto richiesto dalla normativa privacy vigente e futura (D. Lgs. 196/2003 e Regolamento UE 679/2016).
I dati personali e le informazioni acquisite dalla società saranno trattati dalla stessa in qualità di titolare del trattamento per la relativa gestione e saranno conservati non oltre 5 anni dall’esito finale della procedura ed ha quale base giuridica l’adempimento di un obbligo di legge. Il titolare del trattamento dei dati personali è il Dr. Roberto Tundo.

La segnalazione può avvenire rivelando la propria identità oppure rimanendo anonimi. Nel caso in cui si scelga di non rimanere anonimi, BaxEnergy Italia s.r.l. tratterà i dati personali garantendo la riservatezza dell’identità del segnalante e delle altre persone coinvolte nella segnalazione, nonché del contenuto della segnalazione e della relativa documentazione.
BaxEnergy Italia s.r.l. garantisce inoltre l’assenza di ritorsioni nei riguardi di chi segnali in buona fede.
